Il mese scorso, la Corte Suprema Brasiliana ha autorizzato, per la prima volta, l’esplorazione e lo sfruttamento minerario all’interno di un territorio indigeno, su richiesta di un’associazione del popolo Cinta Larga situata nel sud-ovest dell’Amazzonia. Anche se questa decisione non permette immediatamente l’estrazione mineraria nelle terre Cinta Larga, ha stabilito un termine entro cui il Congresso dovrà regolamentare l’attività mineraria nelle terre indigene e ha delineato norme provvisorie in caso di approvazione, tra cui la possibilità di sfruttare solo l’1% del territorio.
Un rappresentante dell’Associazione Cinta Larga Patjamaaj ha spiegato che l’assenza di leggi in materia ha impedito alla comunità di beneficiare economicamente delle risorse minerarie presenti nel loro territorio, compromettendo così entrate destinate a progetti di salute, educazione e sostenibilità. Il Ministero dei Popoli Indigeni (MPI), diversi pubblici ministeri e altre organizzazioni indigene hanno espresso preoccupazione per il precedente che potrebbe stabilirsi, avvertendo che queste nuove regole possono essere interpretate come un’apertura alle richieste future di esplorazione mineraria, mentre le ispezioni ambientali sul campo in Brasile rimangono rare.

Last month, the Brazilian Supreme Court authorized, for the first time, exploration and exploitation of mining within an indigenous territory, at the request of the Cinta Larga people’s association, located in the southwest of the Amazon. Although this decision does not immediately allow mining in the Cinta Larga lands, it set a deadline for the Congress to regulate mining in indigenous lands and outlined temporary regulations in the event of approval, including the possibility of exploiting only 1% of the territory.
A representative of the Cinta Larga Patjamaaj Association explained that the absence of laws on the matter has prevented the community from economically benefiting from the mineral resources present in their territory, thereby jeopardizing income intended for health, education and sustainability projects. The Ministry of Indigenous Peoples (MPI), several public prosecutors, and other indigenous organizations expressed concern about the precedent that could be established, warning that these new rules could be interpreted as an opening to future requests for mining exploration, while environmental inspections on the ground in Brazil remain rare.
