L'Unità: Migranti in Albania, la Corte d’Appello di Roma contro i Cpr meloniani di Gjader: “Dubbi su legittimità del protocollo”
Proprio nel giorno in cui, nelle comunicazioni al Senato alla vigilia del Consiglio europeo, aveva ribadito come il Patto Italia-Albania che ha permesso la creazione di Centri di permanenza per il rimpatrio avesse ottenuto l’ok dell’Europa grazie al Patto su migrazione e asilo voluto dalle destre di Bruxelles, per Giorgia Meloni arriva l’ennesima doccia fredda sul fronte interno.
La presidente del Consiglio aveva utilizzato la tribuna del Senato per tornare nuovamente ad attaccare i giudici che negli scorsi mesi hanno firmato i provvedimenti che hanno liberato i migranti in attesa di rimpatrio trasferiti dai Cpr italiani a quello albanese di Gjader, e a poche ore da quell’offensiva giunge da Roma un nuovo colpo al suo progetto albanese.
“Colpa” della Corte di Appello di Roma che, in tre dispositivi emessi nelle scorse settimane, mette in discussione l’intero impianto del controverso Patto Italia-Albania firmato da Meloni col premer di Tirana Edi Rama, modificato in corso d’opera trasformando il centro di Gjader in un Cpr dalla sua funzione originaria, ovvero centro di trattenimento per richiedenti asilo in attesa delle procedure accelerate di frontiera in quanto provenienti da Paesi sicuri.
“La richiesta di convalida del trattenimento non avrebbe potuto essere pronunciata dubitando questa Corte di Appello della legittimità della disciplina del Protocollo Italia-Albania e della conseguente legge di ratifica, di cui si invoca l’applicazione, per effetto del recentissimo rinvio pregiudiziale sollevato da questa Corte di Appello il 5 e il 17 novembre scorso alla Corte di Giustizia dell’Unione europea”, si legge nei dispositivi emessi della Corte riguardanti tre cittadini marocchini su cui gravava un decreto di espulsione. I migranti hanno riproposto richiesta d’asilo e i giudici hanno confermato che, in attesa della loro domanda, hanno diritto a rimanere su territorio europeo.
In particolare nei provvedimenti, di cui riferisce Repubblica, i giudici della Corte d’appello di Roma affermano che “ancora oggi permangono i dubbi già sollevati rispetto alla compatibilità con l’art. 9 della direttiva europea che prevede che il richiedente asilo ha il diritto di rimanere nello Stato membro fino all’adozione della decisione sulla sua domanda“.

Just on the day when, in communications to the Senate ahead of the European Council, she had reiterated that the Italy-Albania Pact, which had allowed the creation of Centers for Repatriation, had obtained the approval of Europe thanks to the migration and asylum Pact desired by the right-wing factions of Brussels, Giorgia Meloni received yet another cold shower on the domestic front.
The Prime Minister had used the Senate’s platform to once again attack the judges who, in the past few months, had signed the orders that had freed migrants awaiting repatriation, transferred from Italian CPRs to the Albanian center in Gjader, and just a few hours before this offensive, a new blow arrived from Rome to her Albanian project.
“Fault” of the Court of Appeal of Rome, which, in three rulings issued in recent weeks, challenges the entire controversial Italy-Albania Pact signed by Meloni with the backing of Tirana and Edi Rama, modified in course of operations by transforming the Gjader center into a CPR from its original function, namely a holding center for asylum seekers awaiting accelerated border procedures as they come from safe countries.
“The request for validation of detention could not have been pronounced doubting this Court of Appeal the legitimacy of the Italy-Albania Protocol and the consequent ratification law, of which application is invoked, as a result of the very recent preliminary referral raised by this Court of Appeal on November 5th and 17th to the Court of Justice of the European Union, concerning three Moroccan citizens burdened by an expulsion order. The migrants had re-presented an asylum request and the judges confirmed that, pending their application, they have the right to remain on European territory.”
In particular, in the orders, as reported by Repubblica, the judges of the Court of Appeal of Rome state that “doubts still persist regarding the compatibility with Article 9 of the European directive, which stipulates that the asylum seeker has the right to remain in the member state until a decision is made on their application.”

Noa condivide sui social il momento in cui, nella chiesa francescana di San Salvatore al Monte, a Firenze, intona una tradizionale canzone dello Shabbat. “Accogliendo gli angeli della pace, dal mio ‘esilio’ a Firenze. Prego che proteggano la mia famiglia e tutte le anime innocenti” scrive nella didascalia che accompagna il post. La cantante israeliana è rimasta bloccata nel capoluogo toscano dopo l’attacco all’Iran, e deve aspettare prima di poter tornare a casa.

Ma che cosa ci fa Noa in Italia? L’artista sta lavorando alla preparazione del festival Re-Imagine Peace, rassegna che a luglio riunirà artisti israeliani e palestinesi, nata con lo scopo di promuovere la convivenza e il confronto tramite musica e arte. Al momento però è bloccata nel Bel Paese proprio per quello che sta succedendo in queste settimane a livello internazionale. Intervistata da Repubblica, Noa spiega: “Se tutto va bene tornerò martedì notte con un volo da Roma a Tel Aviv. È pericoloso, ma preferisco stare con la mia famiglia anche se giorno e notte bisogna nascondersi nei rifugi”. “Mi sono sentita male quando l’ho saputo”, dice a proposito dell’attacco all’Iran, e ‘rimprovera’ i potenti che in questo momento stanno agitando i popoli a ogni latitudine: “È un gioco politico più grande del conflitto tra Israele e Iran. È un incubo per noi. Sento che siamo nelle mani di leader che danno le nostre vite per scontate. In Russia, Iran, Cina, negli Stati Uniti. Sono molto arrabbiata”.

The Israeli singer has been stranded in the Tuscan capital after the attack in Iran, and must wait before she can return home.

The artist is working on preparing the Re-Imagine Peace festival, a review that in July will bring together Israeli and Palestinian artists, born with the aim of promoting coexistence and dialogue through music and art. However, at the moment she is stranded in the Bel Paese for what is happening in these weeks at an international level. Interviewed by Repubblica, Noa explains: “If everything goes well, I will return on Tuesday night with a flight from Rome to Tel Aviv. It’s dangerous, but I prefer to be with my family even if you have to hide in shelters day and night.” “I felt sick when I heard it,” she says about the attack in Iran, and “rebukes” the powerful figures who are stirring up peoples everywhere at this time: “It’s a political game bigger than the conflict between Israel and Iran. It’s a nightmare for us. I feel that we are in the hands of leaders who take our lives for granted. In Russia, Iran, China, in the United States. I’m very angry.”

Continuano le ricerche di Elena Rebeca Burcioiu, la ragazza di 21 anni scomparsa il 2 marzo nel foggiano. I sospetti degli investigatori, scrive l’edizione barese di Repubblica, sarebbero concentrati su “un uomo originario dell’Europa dell’Est, con tutta probabilità sfruttatore di prostitute nelle campagne foggiane”. Sarebbe lui l’uomo che avrebbe minacciato la ragazza e l’amica che ne ha denunciato la scomparsa riferendo l’episodio.
Orfana e senza fratelli o sorelle, Elena Rebeca Burcioiu era arrivata in Italia da tre mesi e dopo aver tentato di trovare un impiego, per esempio come bracciante, aveva da poco iniziato a prostituirsi nei pressi della statale 16 insieme all’amica. Proprio lì le due ragazze si erano salutate la mattina del 2 marzo dandosi appuntamento per fine mattinata per tornare a casa insieme. La ragazza però non si è presentata e il suo telefono è stato ritrovato lungo la statale.
Le ricerche hanno coinvolto anche i sommozzatori dei vigili del fuoco della direzione regionale di Puglia, provenienti da Bari e Taranto, che, nella notte tra giovedì e venerdì, hanno ispezionato anche un grosso vascone ad uso irriguo senza esito. La prefettura di Foggia ha diffuso una foto della ragazza chiedendo a chiunque abbia sue notizie di contattare il 112.

21-year-old girl missing in Foggia, investigators suspect a man from Eastern Europe.
The search for Elena Rebeca Burcioiu, the 21-year-old girl who disappeared on March 2nd in Foggia, continues. According to the Bari edition of Repubblica, the investigators’ suspicions are focused on “a man originally from Eastern Europe, most likely a pimp for prostitutes in the Foggia countryside.” It is this man who allegedly threatened the girl and the friend who reported her disappearance, relating the incident.
Orphaned and without siblings, Elena Rebeca Burcioiu had arrived in Italy three months earlier. After attempting to find employment, for example as a farmworker, she had recently started working as a prostitute near the A16 highway alongside her friend. It was precisely there that the two girls had said goodbye in the morning of March 2nd, arranging to meet again at the end of the morning to return home together. The girl never showed up and her phone was found along the highway.
The search also involved firefighters from the regional Puglia direction, from Bari and Taranto, who, between Thursday and Friday night, inspected a large irrigation basin without success. The Foggia Prefectures has released a photo of the girl, asking anyone with information to contact 112.
